VITNESS Open Standards License Agreement

IMPORTANT: By using, copying, modifying, contributing to, or distributing the specification documents, schemas, examples, and related materials in this repository (the “Materials”), you agree to the terms of this License.

  1. Definitions
  • “Materials” mean the Fitness Data Standard (FDS) specifications, RFCs, schemas, examples, and documentation contained in this repository.
  • “You” (or “Your”) means any person or entity exercising permissions granted by this License.
  • “Contribution” means any content intentionally submitted by You to VITNESS for inclusion in the Materials.
  1. Grant of Rights Subject to the terms and conditions of this License, VITNESS grants You a worldwide, royalty‑free, non‑exclusive, perpetual license to:
  • Use, reproduce, and distribute the Materials;
  • Create and distribute derivative works of the Materials (including modifications and translations);
  • Implement the specifications and schemas, and make, use, and distribute implementations.
  1. Conditions
  • Attribution: You must retain all notices of authorship, copyright, and license in copies or substantial portions of the Materials.
  • No Misrepresentation: You must not state or imply that Your derivatives are official or endorsed by VITNESS unless expressly authorized.
  • No Trademark License: This License does not grant permission to use VITNESS names, logos, or trademarks.
  1. Contributions By submitting a Contribution, You agree:
  • To license Your Contribution under the same terms as this License; and
  • That You have the necessary rights to grant such license.

  1. Patent License To the extent Your Contribution or distribution of the Materials necessarily infringes Your patent claims, You grant a worldwide, royalty‑free, non‑exclusive, irrevocable (except as stated in Section 7) patent license to make, have made, use, sell, offer to sell, import, and otherwise transfer implementations of the Materials.

  2. Disclaimer of Warranty THE MATERIALS ARE PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE MATERIALS OR THE USE OR OTHER DEALINGS IN THE MATERIALS.

  3. Termination This License and the rights granted hereunder will terminate automatically if You initiate litigation (including a cross‑claim or counterclaim in a lawsuit) alleging that the Materials or an implementation of the Materials infringes a patent.

  4. Severability If any provision of this License is held unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable.

  5. Governing Law This License will be governed by and construed in accordance with the laws applicable in the jurisdiction of VITNESS’s principal place of business, without regard to conflict of laws principles.

  6. Acceptance By using or contributing to the Materials, You indicate Your acceptance of this License. If You do not accept, do not use the Materials.
